realXP is operated by In-Flow Films (ABN 95 161 545 393), based in Queensland, Australia. This page explains how realXP handles personal information and the terms that apply when you use the realXP app, website and related services.
By using realXP, you agree to these Terms of Use. Where consent is required for a particular activity, such as marketing communications or an optional feature, that consent will be requested separately.
Privacy Policy
1. Who is responsible for your information?
In-Flow Films is the operator of realXP and is responsible for deciding how personal information collected through realXP is used. For users in jurisdictions that use the term “data controller”, In-Flow Films is the controller of the personal information described in this policy.
2. Information we collect
Depending on how you use realXP, we may collect and process:
- your name and email address;
- account information, account status and subscription-related status;
- realXP progress and usage information, such as levels, credits, activity history and feature use;
- analytics information about how the app is used;
- crash reports and diagnostic information;
- device information, such as the type of iPhone or other supported device and the installed operating-system version;
- communications you send to us, including support requests, feedback and contact-form submissions;
- your email address and marketing preferences if you voluntarily join a newsletter or marketing list; and
- user-created content if you choose to use an optional cloud backup or synchronisation feature in the future.
realXP does not intentionally collect your date of birth or precise location information. The realXP website does not use cookies for advertising or behavioural tracking. Like most hosted websites, technical server logs may record information such as IP address, date and time, browser type and requested page for security, reliability and troubleshooting purposes.
3. Information stored on your device
Quest names, project names, notes, task descriptions and similar user-created content are currently stored on your device. We do not receive that content merely because you use the app.
realXP may in the future offer optional cloud backup or synchronisation so that you can retrieve or use your information on another device or interface. Cloud synchronisation will be user-controlled and will not be enabled simply because you create an account. If you choose to enable it, the content you elect to synchronise may be stored using our cloud infrastructure.
Please avoid placing highly sensitive personal information in Quest names, notes or similar fields unless you are comfortable storing that information in realXP and, if you enable cloud sync, in the associated cloud service.
4. How we use personal information
We may use personal information to:
- create, operate and secure your account;
- verify your email address and provide password-reset functions;
- provide realXP features, calculate progress and maintain your account state;
- process and administer subscription status;
- understand how realXP is used and improve the app;
- diagnose crashes, bugs, compatibility issues and performance problems;
- respond to support requests, feedback and contact-form enquiries;
- prevent fraud, abuse, repeated introductory offers or misuse of the service;
- send marketing communications where you have separately opted in;
- comply with legal obligations and enforce our Terms of Use; and
- provide optional cloud backup or synchronisation where you choose to enable it.
5. Legal bases for users in the EU, EEA and similar jurisdictions
Where data-protection law requires us to identify a legal basis, we process personal information only where an appropriate basis applies. Depending on the activity, this may include:
- performing our agreement with you and providing the service you request;
- our legitimate interests in operating, securing, troubleshooting and improving realXP, where those interests are not overridden by your rights;
- your consent, including where consent is required for marketing or an optional feature; and
- compliance with a legal obligation.
Where processing is based on consent, you may withdraw that consent at any time. Withdrawal does not affect processing that was lawful before consent was withdrawn.
6. Service providers and data hosting
realXP uses Supabase as a service provider for backend infrastructure, including account and application data storage. Supabase processes information on our behalf to provide those services. We do not provide personal information to advertising networks, and we do not sell personal information.
Information may be processed or stored in countries other than your own depending on the infrastructure and service-provider arrangements used by realXP. Where applicable law requires safeguards for international transfers, we will use appropriate contractual or legal safeguards.
7. Apple and subscriptions
realXP subscriptions are offered through Apple’s App Store. Apple processes payments and billing information under Apple’s own terms and privacy practices. realXP does not receive or store your full payment-card details. We may receive information from Apple that is necessary to determine subscription status, entitlement or transaction state.
8. Account emails and marketing
We may send essential account communications, including signup verification and password-reset emails. These messages are part of operating your account and are separate from marketing.
Marketing or newsletter emails will only be sent where you have separately opted in. You can unsubscribe from marketing at any time using the unsubscribe method provided with the communication or by contacting us. Unsubscribing from marketing does not prevent essential account or security emails.
9. How long we keep information
We keep personal information only for as long as reasonably necessary for the purpose for which it was collected, to provide the service, to protect the service from abuse, or to meet legal obligations. Retention periods may vary depending on the type of information and why it is held.
When you delete your realXP account, we will delete the account and associated personal and progress data, except where particular information must or may lawfully be retained for legal, security, fraud-prevention or dispute-resolution purposes.
To prevent repeated use of free trials, introductory offers or similar benefits, we may retain a non-reversible identifier derived from the account email address after account deletion. This identifier is used only to identify previous eligibility for those offers. It is not used to contact you, restore your deleted account or send marketing.
10. Account deletion
If realXP allows account creation, you can initiate deletion of your account through the app. You may also contact us at info@realxp.app if you need assistance with an account or privacy request.
11. Your privacy rights
Depending on where you live, you may have rights relating to your personal information. These may include rights to access, correct or delete information, restrict or object to certain processing, obtain a portable copy of information, or withdraw consent.
Users in Australia may request access to or correction of personal information we hold about them and may make a privacy complaint. Users in the EU or EEA may also have rights including erasure, restriction, objection and data portability, and may lodge a complaint with their local data-protection supervisory authority. Users in the United States may have additional rights under applicable state privacy laws, including rights relating to access, correction, deletion and certain disclosures or uses of personal information where those laws apply.
We do not sell personal information and do not use personal information for cross-context behavioural advertising.
12. Children and young people
realXP is intended for users aged 13 and over. We do not collect date of birth as part of normal account creation. If you are under the age at which you can legally consent to the processing of your personal information in your country, you should only use realXP with the consent of a parent or guardian.
realXP is not directed to children under 13 and we do not knowingly collect personal information online from children under 13. If we become aware that we have collected such information in circumstances where parental consent is legally required, we will take appropriate steps to delete it.
13. Security
We take reasonable administrative and technical steps to protect personal information against loss, misuse, unauthorised access, modification or disclosure. No online system can be guaranteed to be completely secure, and you are responsible for keeping your account credentials confidential.
14. Contact forms and website enquiries
If the realXP website provides a contact form, we may collect the name, email address and message information you submit. We use that information to respond to the enquiry, provide support and maintain reasonable records of our communications.
15. Privacy complaints
If you have a privacy concern, please contact us first so we can investigate and respond. If you are in Australia and remain dissatisfied, you may be entitled to complain to the Office of the Australian Information Commissioner. If you are in the EU or EEA, you may also have the right to complain to your local data-protection authority.
Terms of Use
1. About realXP
realXP is a productivity and self-management tool designed to help users organise tasks, build momentum and engage with everyday activities through game-style features.
2. Not professional advice
realXP is provided for productivity and self-management purposes only. It does not provide medical, psychological, psychiatric, therapeutic, financial, legal or other professional advice and is not a substitute for professional assessment, diagnosis, treatment, care or advice.
You are responsible for deciding whether and how to act on information, prompts, suggestions or activities presented by realXP. If you require medical, mental-health, legal, financial or other professional assistance, you should seek advice from an appropriately qualified professional.
3. No guarantee of results
realXP does not guarantee that using the service will improve productivity, motivation, wellbeing, performance, habits, health or any other outcome. Results vary between users and circumstances.
4. Eligibility
realXP is intended for users aged 13 and over. If you are under the age at which you can legally enter into these Terms or consent to relevant data processing in your country, you may use realXP only with the involvement or consent of a parent or legal guardian where required by law.
5. Your account
You are responsible for providing accurate account information, keeping your login credentials secure, and for activity undertaken through your account. You must not impersonate another person, create accounts for fraudulent purposes or attempt to obtain repeated free trials, credits, discounts or other benefits in a way that circumvents their intended rules.
6. Subscriptions and payments
Paid subscriptions for the iOS version of realXP are purchased and managed through Apple’s App Store. Billing, renewal, cancellation and refund processes are subject to Apple’s applicable terms, processes and the consumer laws that apply to you.
We may change subscription offerings or prices from time to time. Any changes will be implemented in accordance with Apple’s requirements and applicable law. Nothing in these Terms limits rights you have under mandatory consumer-protection law.
7. Acceptable use
You must not use realXP to:
- break the law or encourage unlawful conduct;
- harass, threaten, abuse or harm another person;
- infringe intellectual-property, privacy or other rights;
- introduce malicious code, interfere with security or disrupt the service;
- gain unauthorised access to systems, accounts or data;
- reverse-engineer, decompile or attempt to extract source code except where applicable law expressly permits it;
- automate, manipulate or exploit credits, referrals, voting, trials, subscriptions or other realXP systems contrary to their intended operation;
- misrepresent your identity or eligibility; or
- use cloud storage or future sharing features to store or distribute illegal, abusive, harmful or infringing material.
8. User-created content
You retain ownership of content you create in realXP. If you choose to upload or synchronise content with realXP infrastructure, you give us the limited permission necessary to host, copy, transmit, back up and process that content solely to provide, secure and support the relevant realXP features.
You are responsible for the content you enter or upload and for ensuring that you have the right to use it. We may restrict access to or remove cloud-hosted content where reasonably necessary to comply with law, protect users or the service, investigate abuse or enforce these Terms.
9. Intellectual property
realXP, including its software, artwork, branding, game systems, text, design and other materials supplied by us, is owned by or licensed to In-Flow Films and is protected by applicable intellectual-property laws. These Terms give you a personal, limited, non-exclusive, non-transferable right to use realXP for its intended purpose. They do not transfer ownership of realXP intellectual property to you.
10. Availability and changes
We may add, remove, modify or discontinue features, content or functionality from time to time. We may also perform maintenance, fix defects or temporarily restrict access where reasonably necessary. We do not guarantee that every feature will always be available or that realXP will operate without interruption or error.
11. Suspension and termination
We may suspend, restrict or terminate access where we reasonably believe an account is being used for fraud, abuse, unlawful activity, interference with the service, circumvention of trial or credit rules, serious or repeated breaches of these Terms, or conduct that threatens the security or integrity of realXP.
12. Third-party services
realXP may depend on third-party infrastructure and platform services, including Supabase and Apple. Those services may be subject to their own terms and availability. We are not responsible for failures or changes in third-party services that are outside our reasonable control.
13. Limitation of liability
To the maximum extent permitted by law, realXP and In-Flow Films are not liable for indirect, incidental, special or consequential loss arising from your use of, inability to use, or reliance on realXP, including loss of productivity, opportunity, data or anticipated benefit.
You are responsible for maintaining appropriate backups of information that is important to you and for exercising your own judgement when using realXP.
Nothing in these Terms excludes, restricts or modifies any guarantee, warranty, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law and other mandatory consumer laws that apply to you. Where our liability cannot lawfully be excluded, it is limited only to the extent permitted by law.
14. Changes to these Terms and this Privacy Policy
We may update this page from time to time to reflect changes to realXP, our practices, legal requirements or platform requirements. The current version will be published on the realXP website with an updated date. Where a change materially affects your rights or how we use personal information, we will take reasonable steps to provide additional notice where required by law.
15. Governing law
These Terms are governed by the laws of Queensland, Australia. You submit to the jurisdiction of the courts of Queensland and courts entitled to hear appeals from them, subject to any mandatory rights you have under the laws of the country, state or territory in which you live.
Nothing in this governing-law clause is intended to remove mandatory privacy, consumer or other statutory rights that cannot legally be waived.
